Copyright law doesnt cover art made solely by AI, according to new decision
Unless a human touches it, it can't be protected.
"The outputs of generative AI can be protected by copyright only where a human author has determined sufficient expressive elements," writes the office in the report's second installment, issued Jan. 29. The office's report lays out further guidelines for the "level" of human involvement in creating AI art using assistive technologies, including the use of computer generated images in the filmmaking process. "Although entering prompts into a generative AI system can be seen as similar to providing instructions to an artist commissioned to create a work, there are key differences.
