FCC votes to ban scam robocalls that use AI-generated voices


The Federal Communications Commission voted Thursday to outlaw scam robocalls featuring fake, artificial intelligence-created voices, cracking down on so-called “deepfake” technology that experts say could undermine election security or supercharge fraud.

The decision to interpret the 1991Telephone Consumer Protection Act (TCPA) more broadly to include AI-generated voices comes weeks after a fake robocall that impersonated President Joe Biden targeted thousands of New Hampshire voters and urged them not to participate in the state’s primary. Dan Jasnow, a partner in the law firm ArentFox Schiff’s AI, Metaverse and Blockchain industry group, said that while the ruling makes it “crystal clear” that AI-powered voice cloning in scam calls are illegal, it isn’t enough. “Protecting our elections and reducing AI-related scams will require a combined effort of government and industry,” he said, “including watermarking of AI-generated content, more robust consumer consent and disclosure mechanisms and a commitment by utilities and telecom providers to act quickly in response to notices of fraudulent and deceptive conduct.”
