The H-1B is a temporary (nonimmigrant) visa category that allows employers to petition for “highly educated” foreign professionals to work in “specialty occupations” that require at least a bachelor’s degree or the equivalent. Before USCIS required registration, the agency conducted a lottery to determine which employers’ petitions for H-1B workers would be processed if the cap was hit during the first five business days of the fiscal year. Another recent study found that restrictions on H-1B visas (such as rising denial rates) motivate U.S.-based multinational corporations to decrease the number of jobs they offer in this country.
